Gerald G. Knapton, an attorney’s fees expert practicing with Ropers Majeski Kohn Bentley PC in Los Angeles, has an article on Code of Civil Procedure section 998, complete with MCLE credit upon taking the accompanying written test, which can be found in the September 2012 edition of the California Lawyer.

Aside from exploring general aspects of the pretrial settlement statutory provisions, he discusses offer-acceptance rules, requirements for enforcement of an accepted 998 offer, the good faith/reasonableness requirement, revocation/multiple offers, 998 offers in multiparty cases, 998 offers in arbitration and specialized cases, and proper proof to obtain expert and attorney’s fees in different 998 contexts.

His Article is a great resource in this area, complementary of co-contributor Mike’s September 2011 article in the Orange County Lawyer.

BLOG KUDOOS–Mr. Knapton has been nominated as an attorney’s fees expert for the Attorney Fee Practice Group of the National Association of Legal Fee Analysis (NALFA), with co-contributor Mike having spoken on a panel at one of NALFA’s recent yearly seminars in Los Angeles.
