COVID-19, PAGA, And ADA Suits Cited, With Report Finding That Each California Resident Pays A “Tort Tax” Of Over $574 Per Person.

            Citizens Against Lawsuit Abuse (CALA), based on a recent 2021 report by John Durham & Associates entitled “The Impact of Tort Costs and the Potential Economic Benefits of Tort Reform in California,” published statistical conclusions that tort reform in California could save state residents and businesses nearly $25 billion, with each state resident paying a “tort tax” of over $574 per person.  COVID-19, PAGA, and ADA cases were mentioned, with 2,700 PAGA and ADA cases filed in federal court in the first six months of 2020.  Co-contributor Mike can attest that many district judges, at early status conferences, echo seeing a flood of ADA cases, and co-contributor Marc is being kept busy as a federal mediator trying to resolve a large number of ADA matters at early stages before attorney’s fees become the stumbling block to settlements.
