Lemon Law Plaintiff Obtained Significantly Less Fees Based On Rejected Section 998 Defense Offer.
On December 30, 2022, we posted on Chen v. BMW of North America, a Sixth District unpublished opinion in which a significantly reduced lemon law fees award to a plaintiff, who rejected a defense CCP § 998 offer, was found to be valid and reasonable. Plaintiff was only awarded a little over $53,000 out of a requested $436,000. We can now report that Chen was certified for publication on January 23, 2023, posted on January 24, 2023.
