MiraCosta College to Contest Fee Motion in Ex-President Settlement Challenge Suit.
In our October 15, 2010 post, we reported on a lawsuit in which MiraCosta College’s settlement with ex-president Victoria Richart was successfully challenged, with the plaintiff now moving to recoup $423,205 in attorney’s fees. Now, Mr. Sisson in a follow-up November 16, 2010 post on the Internet version of The North County Times reports that MiraCosta will oppose the fee request. So, we likely will have more posts to follow on this developing fee saga.
Consolidated Disposal Service Will Bear Defense Attorney’s Fees for Los Alamitos and City Council Members in Lawsuit By Citizens for a Fair Trash Contract.
Consolidated Disposal Service, a trash hauling company, is having its contract with the City of Los Alamitos challenged by a non-profit group known as Citizens for a Fair Trash Contract, with three council members also being named as defendants along with the company and Los Alamitos. As reported by Roxana Kopetman in the November 18, 2010 The Orange County Register, Consolidated apparently will be paying defense attorney’s fees for Los Al and the council members. Then, if the plaintiff prevails, it has the opportunity to move for payment of fees from City or Consolidated (most likely under the private attorney general statute). We will keep you informed on this one, too.
Whacky Escargot Claim.
Okay, time for some pre-Thanksgiving humor.
As recently reported on claimcrazy.com, two men filed a small claims court lawsuit against a restaurant alleging that their escargot burst from their plates and sprayed hot garlic butter on their faces and polo shirts. One man claimed temporary visual impairment, causing humiliation during his birthday celebration at the restaurant. The insurance company saw no negligence on the part of the insured restaurant, so that the matter is apparently proceeding to trial. Snails alive (or dead, as the case may be)–be careful if you prepare an escargot-based dressing for the Thanksgiving bird!
