Opinion Has Some Eloquent Reasoning On Fiduciary Duties/Officer Of The Court Functions By Lawyers.
We do not like to take political stances in this blog, and this post is no exception. We have posted plenty of blogs, both pro and con, relating to court disputes involving former President Donald Trump.
However, U.S. District Judge Linda V. Parker of the U.S. District Court, Eastern District of Michigan, found that she had to sanction pro-Mr. Trump lawyers in an election suit which was based on speculation and “guesswork” affidavits. Although the First Amendment does protect a large ambit of rights, it does not immunize lawyers from sanctions imposed by courts, which “are reserved for hearing legitimate causes of action.” This 110-page decision is instructive reading for all litigators as far as reminding them of their “officer of the court” duties of lawyers when it comes to prosecuting and defending suits.
BLOG FAVORITE OBSERVATION IN THE CASE—There was a reference to “kracken suits,” which refers to a sea monster in Scandinavian folklore that emerges from the sea to devour its enemies.
