SLAPP Update: Cabral v. Martins Is Published

       In our August 22, 2009 post, we reviewed Cabral v. Martins, an unpublished decision by the First District, Division 4 that affirmed a $58,400 fee award to three sets of lawyers for winning a SLAPP motion. Cabral also discussed whether child support evasion statutes “trump” the litigation privilege in a SLAPP context. Now, we can report that the appellate court deciding Cabral issued an order publishing the case on September 4, 2009 based on a request by the winning respondents. It can now be cited!
