No Public Trust Issues Involved, So Joint Request to Reverse Fee Order Granted.
In Park Plaza II, Ltd. v. American Bankers Ins. Co., Case No. G049334 (4th Dist., Div. 3 Jan. 15, 2015) (unpublished), the appellate court had earlier reversed a trial court’s order dismissing a cross-complaint based on a forum selection clause after determining the clause did not apply. Based on that, the parties filed a stipulated request to reverse the trial court’s fee order under Code of civil Procedure 128(a)(8). That request was granted because (1) only a private dispute was involved, (2) no erosion of public trust was involved, and (3) the stipulated reversal has no impact on settlement because the parties only agreed to an outcome already settled on appeal. (In re Rashad H., 78 Cal.App.4th 376, 381 (2000).)
