Acritas Survey on 2011 General Counsel Reasons for Dropping Outside Counsel Reports Results.
Debra Cassens Weiss, in an October 2, 2012 post at the ABA Journal, informs us that Acritas, a UK-based market research firm, conducted a phone survey of a couple thousand general counsel in about 45 countries, asking them about terminating outside counsel in 2011 and the reasons for doing so. 30% of the surveyed GCs dropped at least one of their law firms in 2011, mainly for these reasons: (1) too expensive (21%); (2) bad advice or lack of expertise (18%); (3) poor service (15%); (4) loss of a key lawyer (11%); or (5) ending of the job assignment (16%).
Florida Couple Wins $85,000 Damages For HOA Improper Law Resodding Bill, But Spends $220,000 in Fees and Costs Getting There.
Martha Neil, in an October 1, 2012 post at the ABA Journal, reports on a Florida couple (the Simmonses) who decided to fight a $2,212 law resodding bill from their homeowners association (HOA). This fight went on for 11 years of litigation, with the couple spending close to $220,000 in attorney’s fees and costs. Last week, a Hillsborough County state judge found the HOA didn’t follow proper procedures on the resodding controversy (which resulted in a liening of the couples’ property apparently), awarding the couple $85,000 in damages. The fees/costs request will be decided later, and Mr. Simmons was quoted as saying that the couple will try to sell the house.
