James Otero of the Central District of California decided to grant an anti-SLAPP motion in favor of now President Donald Trump in the defamation case brought against him by Stormy Daniels. He primarily found that the alleged tweets by Mr. Trump were rhetorical hyperbole protected under the First Amendment. Here is a link to his decision. The problem was that he granted a motion to dismiss under Texas’ anti-SLAPP statute, which similar to California’s statute, has a fee recovery provision for successful defendants. We can now report that Mr. Trump has filed a fees motion seeking about $342,000 from Ms. Daniels based on his win.
