In The News . . . . Nice Fee Recovery To Plaintiffs’ Attorneys In Avacor Hair Regrowth System Class Action And Cobles Ordered To Reimburse Caltrans Substantial Costs In Wrongful Death Lawsuit Loss

$9,963,000 Fee Award Approved in Recent Avacor Class Action Settlement.

     As reported by plaintiffs’ lead trial counsel Scott A. Bursor, Alameda County Superior Court Judge Robert B. Freedman, on September 16, 2010, approved a $30 million class action settlement in a case involving false advertisement claims with respect to the Avacor hair regrowth system. Earlier, plaintiffs had obtained a $50 million jury verdict against two members of Global Vision Products’ board of directors. The settlement resolves the claims against the two directors. What did the plaintiffs’ attorneys obtain for fee recovery under the settlement? $9,963,000 under a specified schedule and with a $100,000 holdback pending completion of distribution of settlement proceeds to class members. The case is Thomas v. Global Vision Products, et al., Case No. RG03-091195 (Alameda County Superior Court).

Cobles Suffer Adverse Costs Award of Nearly $292,000 in Caltrans Lawsuit Loss.

     In Orange County, quite a bit of publicity attended the wrongful death lawsuit brought by Lori and Chris Coble, the parents of three young children killed in a fiery crash on I-5 three years ago, against Caltrans. On July 14, 2010, the jury returned a defense verdict in favor of Caltrans. On September 16, 2010, the trial court ordered the Cobles and Cindy Maestri, Lori’s mother, to pay Caltrans costs and disbursements in the amount of $291,534.04.
