In our February 15, 2010 post, we reported on U.S. District Judge Manuel L. Real’s denial of fee recovery to McGuireWoods, class counsel in the BARBRI class action, based on a conflict of interest issue. Because this meant that the firm was denied claimed fees of over $12 million, the stakes were obviously high enough for McGuireWoods to file an appeal with the Ninth Circuit Court of Appeals. For us, this means there will most likely be a follow-up post sometime in the future.
For more details on the appeal, see Zach Lowe’s article “McGuireWoods Wants Its $12 Million in BARBRI Fees” posted March 24, 2010 on The Am Law Daily’s website.
