As reported by Debra Cassens Weiss in an ABA Journal on-line post of August 25, 2014, DeKalb County, GA Judge Dax Lopez ordered defense attorneys to pay fees of $175,000 as a sanction in favor of a plaintiff, where the defendants gambled and lost on “litigating plaintiff to death”—especially after sending an email informing plaintiff that an insurance carrier had agreed to pick up defense costs through appeal. However, plaintiff did not get $250,000 in requested feels, with the same judge finding that not all of the attorney time was justified and that it was not reasonable for plaintiff to retain three separate law firms to prosecute the matter.
