He reports that historically for the past few years, attorney’s fees and costs constitute 70-80% of Proposition 65 settlements. He seems to make the case that the historical high of 80% may have gone down in 2012 to around 70%, depending on what information you use. However, he has very detailed statistical information worthy of evaluation if you are interested in settlements in this area.
