Case Concerns How An Arbitration Party Preserves Ability To Obtain Fees And Costs Under CCP § 998, Whether From Arbitrator And/Or Trial Judge
On June 14, 2017, we posted on Heimlich v. Shivji, 12 Cal.App.5th 152 (2017). We can now report that the California Supreme Court granted review of this case, assigning it Case No. S243029, on August 23, 2017. Here is the Issues Summary of this matter: “When a party to an arbitration proceeding makes an offer of compromise pursuant to Code of Civil Procedure section 998 and obtains a result in the arbitration more favorable to it than that offer, how, when, and from whom does that party request costs as provided under section 998?”
