Frivolous Appeal, In Tandem With Citations Outside Of Appellate Record, Sealed The Deal.
In Brown v. Butler, Case No. D075348 (4th Dist., Div. 1 May 19, 2020) (unpublished), the appellate court, on its own motion, requested briefing on why the appealing party and his attorney should not pay sanctions for a frivolous appeal, based on the merits and citing matters outside of the appellate record. Well, we like to stay on top of these things and can report that $15,000 was the sanctions for a frivolous appeal, payable to the clerk of the appellate court.
