In our May 28, 2010 post, we reported on the decision of Center For Biological Diversity v. County of San Bernardino, a decision that was partially published but was not certified for publication on the discussion of a fee award under California’s private attorney general statute. We can now report that the entire decision has been certified for publication through a publication order issued by the Court of Appeal on June 23, 2010. So, you can now visit our May 28 post and cite this case with some authority (although some trial courts will want the time for review to pass before they give decisions binding precedential authority).
