In The News . . . . Boston Law Firm Sues Merrill Lynch For Predecessor’s Failure To Disclose Fee Cap

Suffolk County Superior Court is the Venue of this Legal Dispute.

     In yet another interesting twist on attorney’s fees in the news, Sheri Qualters, in a January 19, 2011 post in The National Law Journal, reports that the Boston law firm of Davis, Malm & D’Agostine is suing Merrill Lynch, as successor to Banc of America Securities LLC (BOAS), for BOAS’ failure to disclose that it had agreed on a $50,000 cap on legal fees with the South Shore Tri-Town Development Corp. relating to certain bond issue work for a redevelopment project.

     Not only does the suing firm claim that the fee cap was not disclosed, but it also claims that that BOAS led it on by assuring full payment until the firm received only $50,000 from South Shore.

     The case is venued in Suffolk County Superior Court and was filed on January 5, 2011.
